Segway Service Rewards Campaign – Terms & Conditions
These Terms and Conditions apply to the Segway Service Rewards Campaign described in the linked announcement (e.g., a post on Segway’s website, email, or Segway-Ninebot App). By participating in this Promotion, you agree to abide by these Terms and Conditions.
1. DURATION
April 15, 2025 - May 11, 2025
2. ELIGIBILITY
This Promotion is only available to existing Segway product owners (accessories & parts are excluded). To participate, you must be 18 years or older and reside in the contiguous United States.
3. METHOD OF PARTICIPATION
Follow the instructions in the linked campaign announcement to participate. Participants must verify their Segway product ownership via email address on the campaign page. To receive the corresponding service rewards, participants must purchase eligible Segway products during the promotion period.
4. ELIGIBLE PRODUCTS
- Segway eKickScooter F3
- Segway eKickScooter MAX G3
- Segway SuperScooter GT3
- Segway eKickScooter ZT3 Pro
5. NON-TRANSFERABILITY
Reward value is for promotional purposes only. The estimated value of the 6-month Warranty Extension is based on average cost of labor and spare parts for the eligible products. The value of Shipping Protection is calculated as 2% of eligible product value, with a maximum reward value of $34 regardless of higher order value. Rewards cannot be redeemed for cash, credit, or exchanged for any other goods, services, or monetary equivalent in any form.
6. TAX
All income taxes resulting from the acceptance of the rewards are the sole responsibility of the recipient.
7. PRIVACY
The Promotion may require you to provide personal information (e.g., email address) to verify eligibility. For more information on how we collect and use your personal information and your privacy rights, please view our Privacy Policy.
8. LIMITATION OF LIABILITY
(a) SEGWAY-NINEBOT PARTY’S (INCLUDING SEGWAY INC., NINEBOT AND THEIR AFFILIATES, DIRECTORS, MANAGERS, EMPLOYEES, OFFICERS, SUCCESSORS, AGENTS, AND INDEPENDENT CONTRACTORS) LIABILITY TO YOU, WHETHER BASED ON CONTRACT, TORT, WARRANTY, OR ANY OTHER THEORY, SHALL NOT EXCEED THE MSRP OF THE PRIZE THAT YOU WIN.
(b) IN NO EVENT SHALL EITHER SEGWAY-NINEBOT PARTY BE LIABLE TO YOU FOR ANY CONSEQUENTIAL, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR ENHANCED DAMAGES, LOST PROFITS OR REVENUES, OR DIMINUTION IN VALUE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
(c) THE FOREGOING LIMITATIONS OF LIABILITY APPLY EVEN IF YOUR REMEDIES UNDER THIS AGREEMENT FAIL OF THEIR ESSENTIAL PURPOSE.
9. NO DEFAMATION
Neither party shall denigrate, disparage, tarnish, or present the other in a false light, or otherwise harm the reputation or goodwill of the other party.
10. GOVERNING LAW AND ARBITRATION
(a) This Terms and Conditions and any claim, dispute, and/or controversy between parties related to the Promotion shall be construed and enforced in accordance with and governed by the laws of California without regard to conflict of law principles.
(b) All disputes arising out of or relating to the Promotion, or any breach hereof, which cannot be settled amicably, shall be finally and exclusively settled by arbitration in English in your residence county (unless both parties agree otherwise), under the rules of the American Arbitration Association.
(c) The arbitral tribunal shall have the sole power to rule on any challenge to its jurisdiction.
(d) Judgment on the arbitration award may be entered by any court having jurisdiction.
(e) The parties agree to keep confidential all aspects of the arbitration process, including proceedings and outcomes, except as required by law.
11. WAIVER OF CLASS ACTION AND CLASS ARBITRATION
To the extent permitted by law, any disputes between the parties arising from the Promotion shall be resolved through individual arbitration, and not through class actions or class arbitration. Each party waives the right to participate in class actions or class arbitrations.
12. TERMINATION AND MODIFICATION
Sponsor reserves the right to interpret, modify, or terminate the Promotion and its Terms and Conditions at its sole discretion, without prior notice. A breach of these terms may result in forfeiture of your right to participate and any rewards you may have won.
13. VOID WHERE PROHIBITED
Void where prohibited.
